Health data policy

Airmine AS (“Airmine”, “we”, “us”, “our”) take your privacy seriously. This Health Data Policy explains our practices in connection with health information that we collect through the App, Websites and Services. By downloading, accessing or using the App, Websites or Services, or providing information to us in connection with the App, Websites or Services, you agree to the terms and conditions of this Health Data Policy.
“App” means the Airmine Pollen app.
Some features described in this Health Data Policy may depend on the version of the App you are using and may be introduced gradually.
1 Types of health data we collect
You can register your pollen allergy symptoms in the App. These symptom entries can be classified as health data.
Health data is not collected unless you voluntarily input it. We do not collect any other forms of health data than pollen allergy symptoms levels.
The symptom diary feature is only available to users who are eligible to access age-restricted features, where such eligibility can be determined based on app store platform signals. For details on how this is determined, see Section 10 of our Privacy Policy.
Where the applicable platform provides such signals and indicates that an account is classified as a minor, may be under the age required to access the feature, requires parental consent, or is a supervised child account under Apple Family Sharing or Google Family Link, the diary feature is not available and no health data will be collected from that account.
2 Legal basis for processing
To log pollen allergy symptoms in the App, you must provide explicit, informed, and granular consent to allow Airmine to collect and process your health data. You will be asked to accept this when you activate the diary feature. You may withdraw consent at any time under Settings > Privacy & Data > Health Data Settings. We will store a record of your consent or withdrawal of consent in our databases.
You can choose to consent to all the purposes listed in section 3, or just a selection of the purposes (granular consent).
If you choose to not accept purpose 3.1, App functionality, you will not be able to use functionality that requires symptom logging. You can still use the App. You can also see any symptoms you logged earlier (in periods when you gave us your consent). If you choose not to accept purpose 3.1, purposes 3.2 and 3.3 are not relevant and will be set to not accepted.
3 Purposes of our use of health data
3.1 App functionality
We use the health data to give you functionality in the App. You can log your pollen allergy symptoms, see your symptoms history and get personalised forecasts/analysis.
3.2 Improve pollen forecasts
We use the health data to improve our pollen forecasts. The forecasts are used both in the App and in our other products and services. We use the health data on an aggregated basis without any personal information. We do not disclose any health data or other personal data in this process.
3.3 Aggregated symptoms
We may use the health data to create displays of aggregated symptoms levels, as a symptoms map in the app and other Airmine products and services. We only use the health data on an aggregated basis and it will not be possible to identify single users.
4 Storage of health data
We store health data securely in the EEA. If we transfer data internationally, we use SCCs or equivalent safeguards.
5 Who has access to your health data?
Airmine employees
Airmine staff and contractors, like consultants, have access to personal data for the purpose of providing services. Access is granted on a strict need-to-know basis.
No personally identifiable data is stored on staff or contractor computers on a permanent basis.
Third parties
We do not sell health data to any third party for monetary or other valuable consideration, and we do not share health data with third parties for targeted or cross-context behavioural advertising, except as specified below. This applies globally, and is intended to meet the stricter of the applicable requirements, including those of U.S. state consumer-health-data laws (for example, the Washington My Health My Data Act).
We will ensure that any third parties processing data on our behalf enter into GDPR-compliant Data Processing Agreements. For international transfers of data, we will adhere to GDPR requirements such as Standard Contractual Clauses.
Your data may be disclosed to a third party in the following instances:
1) As We develop our business, We might sell or buy businesses or assets. In the event of a sale, merger, reorganisation, dissolution or similar event relating to all or a portion of our business or assets, your personal information and data may be part of the transferred assets.
2) We may also disclose your data if required to do so by law or in good faith that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public.
3) Service providers. We may share personal information with our trusted service providers who perform services on our behalf (e.g. web hosting, technical support, processing of payment), but strictly for the purpose of carrying out work on our behalf as described in this Health Data Policy.
4) We may include your symptoms when we aggregate data for creating symptom maps, graphs or statistics, these may be provided to users in the app and in other products. Your data will only be included in the aggregates if you have consented to purpose 3.3 “Aggregated symptoms”. Aggregated symptom data is fully anonymized and cannot be traced back to any individual. We do not sell or share personally identifiable health data. Aggregated and anonymized symptom insights may be used in commercial offerings aimed at improving public health or allergy management, without disclosing any individual-level data.
6 Your data rights
You have the right to access, correct, delete, and export your health data. These rights can be exercised via app settings or by contacting support@airmine.ai. We respond to verified requests within the legally required timeframes.
You can delete all your personal data in the app, see App Manual for how to do this.
7 Retention
Identifiable health data is automatically deleted after 2 years of inactivity, or sooner if you withdraw your consent. Aggregated, fully anonymized data may be retained indefinitely for research and statistical purposes.
8 Changes to the health data policy
We reserve the right to update or modify this Health Data Policy at any time without prior notice. If We make material changes, We will provide notice to you by digital means, for example a pop-up in the App. You can always change your consent to the use of Health Data, see App manual for details.
9 Important note
Airmine is, under no circumstances, meant to make a diagnosis or provide treatment for allergies or any other health condition. For a proper diagnosis of your medical condition and the treatment that may stem from such a diagnosis, we recommend you consult a doctor or related health care professional.
